Do I need to file a report to apply?

Sometimes people do not have a police report or legal complaints about the harmful situations they have experienced. The good news is that this is not a requirement for a T visa. If it is necessary to submit a report to an agency with your T visa application, our office will take care of all of that. What is required of the person applying is being willing to cooperate with an investigation if that agency later decides to investigate the situation involving the abusers. In many cases, it is necessary to show cooperation with authorities, but there are important exceptions, especially when the victim has suffered trauma or faces risks. Can I get a work permit with a T visa?

Yes. People who apply for or receive a T Visa may be eligible to obtain a work permit, which allows them to work legally in the United States while their case moves forward. Previously, applicants had to wait until the final review and approval of the T Visa application. However, due to a policy change in 2024, the T Visa now has a Bona Fide Determination (BFD) status program, similar to the one for the U Visa. This means that if the USCIS officer determines that your case is bona fide after the initial review, you may be able to apply for a work permit earlier while your application remains pending and awaits the final review and decision in your T Visa case.
